2 ASTM UPDATE: "Committee E52 Active Standards"

Jack Ogilvie, who is on the E52 ASTM committee for
polygraph standards, has given me their current Active
Standards to post here in the Relevant Issue.

In upcoming issues, Jack will be breaking down various
areas of the standards for a closer look. Following
each of these articles, we will be launching a
corresponding topic in the examiners private forum to
discuss these standards at a deeper level.

Don't forget these standards effect us all, so please
contribute. The level to which you participate outside
of your 'daily polygraph duties' shows the level that
you really care about your profession.

Many thanks to Jack and others who give freely of their
time to make this profession better.

4. TRUE POLYGRAPH STORIES: "Just pulling my leg"

As with every Examiner, our career best tests are always
a phone call away at any time of day or night, and with
my business lines, cell phone, pager, and keen eye for
any smoke signals on the horizon; I knew that I would
not miss any such test. The phone rang one Fall day in
2003 and it was from the lead Attorney of a prestigious
law firm in the Bay area. This law firm specialized in
Immigration Law, as I learned in the approximate one
hour conversation. Further, that they represented a
large caseload of individuals who were claiming and
petitioning for Political Asylum in their respective
cases in regard to the treatment they had received in
their home country, which caused them to leave there in
desperation. He went on to explain that the Immigration
Hearings and Court proceedings were just not getting
the job done as many deserving cased were being
rejected.

In his legal opinion he wanted some further “Ummph” he
could put into the case in support of the Petitioner’s
claims if such were the case. While he knew that our
field was highly regarded by those in the know, he was
not aware that we were computerized with associated
scoring Algorithms capable of providing an “Objective”
opinion predicated on known solution data / tests vs.
the mere “Subjective” opinion which a professional
Examiner could perform with an older Analog instrument.

Things progressed and somewhere into my fiftieth
examination for this firm came a call from a saddened
and tearful young paralegal who worked for this law
firm. She went on to explain how one of their clients
had been denied in his case, and they needed a test done
immediately. I stopped her in mid-sentence somewhere and
asked her why she was upset in delivering this
information to me, as I had wondered if the tone of her
voice was evident of some other unrelated personal
tragedy. She then informed me that she was deeply
affected by the Client’s possibility of having to be
sent home to his native land. Further, that he was the
claimed victim of torture, to the point where he had
lost his leg from Police brutality in his native land,
and that after torturing him they ran over him in their
Police Jeep which caused the loss of his limb. Further,
that his Wife had been gang raped by these same Police
as a component of their Torture of them for their
Political and Religious beliefs. She further stated that
they feared that if they returned to their home country
that “Surely, they would be further mistreated or
killed”.

I responded that I would look at the case by reading
what she could fax me. She further asked me if his
having one leg would cause any problem in testing, to
which I responded “NO”, on that limited basis alone.
Further, that I have even had the experience of
Previously Performing Polygraph on a Paraplegic
Presumed a Pedophile ( I just love Alliteration!) While
this lightened her mood a bit, I knew I had an
interesting case to attend to.

Let me take a moment to mention that I do not mean to
make light of those with missing limbs or a handicap in
any way. I have vivid memories of a loving Maternal
Grandfather who had lost a limb as a young railroad
worker in the great depression of the 1930’s, and who
made me very comfortable as a child with his personal
presence which carried over in my life to others who
had suffered a similar loss. My intent in including the
mention of this is that I was easily able distinguish a
separation about the issues of Truth and Deception in
this case, and not kept from treating this individual
as a whole and complete person.

Upon review, the case seemed clear to me as being a pure
lie Issue, and the appointments were scheduled. I
determined that I would run a Zone (ZCT) in regard to if
they as individuals had lied in any part of their
submitted paperwork to the INS in their respective
claims for Political Asylum.

The test day came about a week later. The Gentleman
arrived with his wife, and he appeared well adjusted and
personable to the cards life had dealt him. I performed
the very professional greeting and introduction all of
us had been taught so many years ago in polygraph
school. Further, I knew he would be sizing me up to
determine if I would be giving him a fair test that day.
Somewhere into the approximate tenth minute of him
being seated in my office, I could see his posture in
the chair become relaxed. I progressed into explaining
the computer polygraph process and to satisfy his
curiosity about the various tracings, and their origin
from the components professionally placed on the nearby
padded polygraph chair. From his view, and so many
others whom I had tested from his country, I knew that
seeing these components and these tracings was a kin to
their stepping aboard the Starship Enterprise Ship’s
Bridge area, as it was so very far over their head.

More importantly, I projected into the equation that
such individuals who had various devices and methods
used on them in the past in torture sessions, that they
would clearly wonder if this would be a painful event
such as seeing a Dentist might conjure up. After
brilliantly breaking beyond these benign barriers (There
I go again with Alliteration !) he seemed very
comfortable with it all.

Just for good measure, and common in my pre-test, I
elected to show him an instant replay of another
individual’s charts in my computer (Also from his
Country) who had easily run NDI in their test, as I
thought this would build confidence for his benefit.

To my deep surprise his reaction to seeing this test
result was to rather cringe in his chair. He then looked
up at me with a wide eyed expression and half smile and
said "Well, You Know, It was all just a story!"

Not allowing Silence to overcome the room, and not
missing a beat, I asked if he was injured in some other
way, and perhaps as a child ? He responded that the loss
of his leg was in fact due to a childhood accident
through medical malpractice, and that his story for
political asylum was a sham, and that his wife was never
arrested or gang raped due to his political
activities/beliefs.

Being from the Mid-West, and in our inherent folksy way,
I uttered without thinking about it (No Pun Intended)
"Well, I guess you were just pulling my leg in this case
until today!" He concurred.

Upon their leaving my office (No need to have tested the
Wife) I called the case paralegal for the law firm, and
explained that the client had in fact been desperate to
stay in the USA, and that he had made up a story
inclusive of the loss of his limb, which had in fact
occurred much earlier in his life. Her former tears
flowed no more when she determined that she had been
HAD! After getting over her surprise and the shock of my
communicated message of his mischief, she slowly boiled
into anger, and I’m told transferred his case to an
unbiased person in their office.

To this day, and particularly when someone has tried to
tell me a story, I no longer say "Are You Just Pulling
MY Leg?”
