polygraph business"
The new state banners available
on the Polygraph place

2 TRUE POLYGRAPH STORY: "Boy Passes Polygraph Test After
Failing CVSA Test" by Jim Morris
TRUE STORY: I conduct polygraph
examinations on many adult
and juvenile sex offenders during different phases of the
criminal proceedings i.e. Pretrial, Pre-sentence and Post
Conviction. In this particular case a 16-year-old boy was
ordered to this specialized sex offender treatment center
for a pretrial, sex offender risk assessment which is a
psychosexual evaluation. This judge requires such
assessments to assist in decisions as to probate or
incarcerate the offender.
On the day of the exam I review
the offender's treatment
file to see what has been learned by the clinical
interviews and testing by the treatment team. The
polygraph portion is the very last step of the risk
assessment evaluation. Part of the file contains the
police investigator's report. It read as most do. It
contained the case facts, victim's statement and the
signed confession of the perpetrator. The offender had
also been caught a couple of years earlier being sexual
with the victim. There was nothing out of the ordinary
except there was a Lie Detector (CVSA) report. It stated
the usual false claims about being 100 % accurate, etc,
and went on to say that the suspect failed the test and
confessed to the crime. My only thought at that time was
more propaganda for CVSA, (a test to verify their machine
by a confession instead of validity studies).
While doing my standard pretest
interview I asked the
offender what was it that he confessed to. He stated that
he had tried to perform anal intercourse on his 14-year
old brother. I asked if he is guilty of what he confessed
to? The offender said No. I then asked why did he confess
to something that he had not done. He said that he had to.
I asked him to explain.
He stated that he and his
brother had gotten into an
argument over something and the boy said that he was
going to get even. The next thing he knew his mother had
called the sheriff’s office he was talking to a county
detective about molesting his brother. He stated that he
told the detective that he had not done anything sexual
with his brother and that his brother was lying. He said
that he did tell the detective about getting caught a
couple of years earlier being sexual with his brother but
that there has not been any type of sexual contact between
the two since that time. The boy was taken to the
detective’s office to continue with the interview. The
detective offered him a (CVSA) Lie detector test. After
the test the detective told him that he failed the test.
I guess I should mention that
the Investigator,
Interviewer, CVSA operator and Interrogator are all one
person. The boy said that he was interrogated for around
six hours. He requested to talk to his mother and was told
he could not. He stated that the detective finally told
him that he was not going to be allowed to go home until
he confessed to the crime. The boy said, “I would have
said anything he wanted me to say at that time so that I
could go home”. So the boy confessed, then the detective
locked him up.
As a matter of practice, anytime
in a Risk Assessment exam
if the person tells me that they did not commit the
offense and I have enough information, I conduct a
Specific Issue exam. The Relevant issue in this case is
did he perform any type of sex act with his brother during
the specified month of the reported offense. I limited the
time frame to that particular month due to the past sexual
contact he had with his brother. The results were NDI (No
Deception Indicated)
I inquired a month or so later
as to what happened when
the case went back to the court. I was told that the judge
was given the evaluation from the sex offender treatment
center during the hearing. After reading the report the
judge called the brother (victim) up to the bench as asked
“Why are you lying about your brother?”. The boy told the
judge something about an argument that he and his brother
had gotten into and that he just wanted to get his brother
into trouble. – Case Dismissed --.
The worst thing about this
case is that this boy was about
to go through life with the unwarranted label of
“Convicted Sex Offender”. He would have gotten that label
due to the use of an invalidated machine and a coerced

Evidentiary polygraph examinations
are experiments in which
we, the experimenters, attempt to eliminate as many
variables as possible in our testing format so that what
remains is the null-hypothesis which we intended to prove.
The null-hypothesis states there is no significant
difference between the relevant and comparison questions
in a ZC protocol. By including the outside issue question,
we add a variable.
The degree to which the inclusion
of the outside issue may
or may not contaminate the experiment is grist for debate.
However, the outside issue question is omitted in test
format variations taught at and validated by DODPI. These
formats are employed by the US Secret Service, US Naval
Criminal Investigative Service and the Air Force Office
of Strategic Investigations.

There is an additional problem
with the outside issue
question when asked of an examinee whose first language
is not English. Frequently, the outside issue question is
the apparent greatest threat to the well-being of the
English as a Second Language examinee, not because he or
she is concerned with an outside issue, but simply because
he or she does not understand it. Any responses can
mislead the examiner. Sometimes, the KISS Principle is
best.
